1. Introduction

Welcome to eCardForever (“eCardForever”, “we”, “us”, or “our”), operated at eCardForever.com. eCardForever is a permanent digital identity platform that lets individuals and businesses create customizable online profiles (“profiles” or “eCards”), share them through unique links and QR codes, and present professional or creator presence online.

These Terms & Conditions (“Terms”) govern your access to and use of our website, applications, and related services (collectively, the “Platform”). The Platform is operated from Malaysia by Your Partner Technologies and related entities providing eCardForever services.

2. Acceptance of Terms

By creating an account, accessing a public profile, browsing themes or designs, or otherwise using the Platform, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree, you must not use the Platform. Where you register on behalf of an organisation, you confirm that you have authority to bind that organisation to these Terms.

3. User Accounts

To create and manage a profile, you must register for an account. You agree to provide accurate information, keep your login credentials confidential, and notify us promptly if you suspect unauthorised access.

You are responsible for all activity that occurs under your account, including edits to your profile, theme or design selections, and connection or sharing features you enable.

4. Username Responsibility

Your public profile is typically available at a URL based on your chosen username (for example, eCardForever.com/yourname). Usernames must comply with our format rules and must not:

• Impersonate another person or brand without permission;
• Include offensive, misleading, or unlawful terms;
• Infringe trademarks or reserved names used by the Platform.

We may reclaim or change usernames that violate these Terms or create confusion, security risk, or legal exposure.

5. Platform Usage Rules

You agree to use the Platform only for lawful purposes and in a manner consistent with professional and respectful online conduct. You will not attempt to:

• Interfere with Platform security, availability, or performance;
• Access accounts or data that are not yours;
• Scrape, reverse engineer, or overload our systems without permission;
• Use the Platform to distribute malware, spam, or deceptive content.

6. Public Profile Visibility

Unless you use features that restrict access (where available), information you place on your profile—such as your name, photo, job title, contact details, links, and action buttons—may be publicly visible to anyone with your link or QR code.

You control what you publish on your profile. Please review your profile carefully before sharing it at events, on social media, or in email signatures.

7. QR Code Usage

The Platform may generate QR codes that link to your public profile. You are responsible for how you print, display, or distribute QR codes, and for ensuring recipients understand they will be directed to your online profile.

We do not guarantee that third-party scanners, printers, or offline materials will always render QR codes accurately.

8. User Content Responsibility

“User Content” means text, images, links, contact fields, backgrounds, and other materials you upload or display on your profile. You retain ownership of your User Content, but you grant us a limited licence to host, display, and technically process it solely to operate the Platform.

You represent that you have the rights to all User Content you publish and that it does not violate any law or third-party rights.

9. Prohibited Activities

You must not use the Platform to:

• Harass, defame, or discriminate against others;
• Publish illegal, fraudulent, or sexually exploitative material;
• Promote violence, hate, or dangerous activities;
• Collect personal data from visitors without a lawful basis and clear notice;
• Violate intellectual property, privacy, or consumer protection laws in Malaysia or other applicable jurisdictions.

10. Intellectual Property

The Platform, including its software, branding, layout systems, default themes, and documentation, is owned by us or our licensors and is protected by applicable intellectual property laws. Except as expressly allowed, you may not copy, modify, or redistribute Platform materials.

11. Theme & Design Usage

We offer visual themes and layout designs for your profile. Themes and designs are licensed for use within the Platform to style your profile. You may not extract, resell, or repurpose theme assets outside the Platform without our written consent.

Theme and design choices remain subject to these Terms and must not include unlawful or infringing material.

12. Free Service & Future Pricing

At this stage of our operations, eCardForever is offered to you free of charge for the core features available on the Platform today. We do this to make digital identity accessible while we continue to improve the service.

We reserve the right, at our sole discretion and subject to applicable law, to introduce in the future:

• Paid subscription plans or tiers;
• Premium or add-on features;
• Usage limits, quotas, or access restrictions on free or paid plans;
• Changes to pricing, billing cycles, or payment methods; and
• Different levels of access to themes, designs, storage, or other Platform capabilities.

Any such changes will be communicated through the Platform, by email where appropriate, or by updating these Terms. Where fees apply, we will present applicable pricing and terms before you are charged. Your continued use of paid or modified services after those changes take effect constitutes your agreement to the updated Terms and any applicable fees, unless you cancel in accordance with the instructions we provide at that time.

Nothing in this section creates an entitlement to perpetual free access. Free access during the current period does not guarantee that the same features will remain free indefinitely.

13. Account Suspension & Termination

You may delete your account through account settings where available. We may suspend or terminate access if you breach these Terms, create risk for other users, or where required by law.

Upon termination, your public profile becomes unavailable and your business content is permanently removed from the Platform. We do not retain deleted business content in platform archives or history tables. Operational, security, audit, and monitoring metadata may be retained as described in our Privacy Policy and as required for legal or operational purposes.

14. Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis. To the fullest extent permitted by Malaysian law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.

15. Limitation of Liability

To the maximum extent permitted by law, we and our officers, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Platform.

Our total liability for any claim relating to the Platform shall not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim, or (b) one hundred Malaysian Ringgit (MYR 100), except where liability cannot be excluded under applicable law.

16. Platform Availability

We aim to keep eCardForever reliable but may perform maintenance, updates, or changes that temporarily affect availability. We may modify or discontinue features with reasonable notice where practicable.

17. Changes to Terms

We may update these Terms from time to time. We will post the revised version on this page and update the effective date. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of Malaysia. You agree that the courts of Malaysia shall have exclusive jurisdiction over disputes arising from or relating to these Terms or the Platform, subject to any mandatory consumer protections that apply to you.
